I understand that basketball training and athletic activities involve inherent risks, including but not limited to the risk of serious physical injury, temporary or permanent disability, and death. These risks may result from my own actions or inactions, the actions or inactions of others participating in the activity, the condition of the facilities or equipment, or the negligence of the Released Parties (as defined below).
I voluntarily assume all risks associated with my (or my child's) participation in any and all activities conducted by Next Generation Athletics ("NGA"), including but not limited to basketball training sessions, group classes, private coaching, camps, leagues, tournaments, open gym sessions, and any related activities.
In consideration of being permitted to participate in NGA programs and activities, I hereby release, waive, discharge, and covenant not to sue NGA, its owners, officers, directors, employees, coaches, trainers, volunteers, agents, and representatives (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me (or my child) while participating in NGA activities or while on premises owned or controlled by NGA.
I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, suits, losses, damages, costs, and expenses (including reasonable attorney's fees) arising out of or related to my (or my child's) participation in NGA activities, including any claims brought by third parties.
I authorize NGA and its representatives to obtain or provide emergency medical care for me (or my child) in the event of injury or illness during participation in NGA activities. I understand that I am responsible for all costs associated with such medical care. I represent that I (or my child) am physically fit and have no medical condition that would prevent safe participation in basketball training activities.
I agree to inform NGA of any medical conditions, allergies, or physical limitations that may affect participation. If any such conditions exist, I understand that participation may be subject to additional requirements or restrictions.
I grant NGA permission to use photographs, video recordings, and other media containing my (or my child's) likeness for promotional, educational, and marketing purposes, including but not limited to social media, website content, print materials, and advertising. I waive any right to inspect or approve such materials and release any claims for compensation related to such use.
I agree to abide by all rules, policies, and instructions provided by NGA coaches and staff. I understand that NGA reserves the right to remove any participant whose conduct is deemed unsafe, disruptive, or inappropriate, without refund.
I understand that I (or my child) am responsible for inspecting equipment and facilities before use and for reporting any unsafe conditions to NGA staff. I agree not to use any equipment or facilities that appear unsafe or damaged.
I have read this Liability Waiver and Release in its entirety and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
If signing on behalf of a minor child, I represent that I am the parent or legal guardian of the child and have the authority to bind the child to this agreement.
This agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising under this agreement shall be resolved exclusively in the courts of British Columbia.
If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
